This is one of the most corrupt Supreme Court's since Buchanan reached out directly to Justices Catron and Grier in 1858 telling them to go beyond the particulars of th Dred Scott case and issue a decision legitimizing slavery throughout the United States.

(7,842 posts)I know her politics don't align with ours, but I'm impressed she seems to be a neutral jurist, and doesn't seem completely in anyone's pocket. Similar to Roberts who can be infuriating but seems to at least consider what side of the scale he comes down on from time to time.
I'm tired of holding out hope, but it's a fantasy that if/when Cannon gets appointed to the SC that Barrett might slap some sense into her.

(18,999 posts)A divided Supreme Court refused to delay Donald Trumps sentencing in his hush money case, clearing the way for the president-elect to face judgment in a New York courtroom on Friday and to be formally classified as a felon before he returns to the White House.
Trump turned to the Supreme Court in a last-ditch effort to stop the hearing, citing the conservative majoritys explosive opinion in July that granted him and other former presidents immunity from criminal prosecution for their official acts.
He is set to be sentenced Friday, after a jury convicted him of 34 counts of falsifying business records related to a hush money payment made to an adult-film actress during the 2016 election. New York Supreme Court Justice Juan Merchan, who presided over Trumps trial, has said he does not plan to give the incoming president jail time or probation.
But the completion of the sentencing hearing would formalize Trumps status as the first former president or president-elect convicted of criminal wrongdoing a designation Trump had hoped to avoid.

(7,777 posts)But my understanding is that Trump can (and will) appeal but the appeal cannot overturn the jury verdict. The appeal can only be based on errors by the Judge - by applying the wrong law, etc. That could result in a new trial being ordered. This is the likely route Trump will take.

An unconditional discharge, as Trump is likely to get, can be imposed under New York state law when the court is of the opinion that no proper purpose would be served by imposing any condition upon the defendant's release. When a defendant is given an unconditional discharge, the court will have to give its reason for doing so, and the defendant is released without imprisonment, fine or probation supervision, according to New York law...
WHAT CANT TRUMP DO AS A CONVICTED FELON?
Convicted felons face a number of restrictions, though many of them are unlikely to apply to Trump, like holding state public office. Trump will not be able to serve on a jury or own a firearm, and most notably, many countries have travel restrictions that bar convicted felons from entering, which means that as president he may have to get special permission for some travels. That wouldnt be a first, as CBS News notes President George W. Bush had to get a waiver to travel to Canada as president because he previously pleaded guilty to drunk driving. More than a dozen countries have such restrictions in place, including Australia, Canada, China, Japan and the United Kingdom.

The Felon Prez will never live this sentencing down. It will also taint his rethug loyalists.
We also will likely see corp media double down on sane washing the Felon President's second term.
As for him, he won't allow any but Fox in the WH Press Room anyway -- if he even has a press secretary -- no one will get to report without his pre-approval.

(6,403 posts)... This was a denial of a stay for sentencing, not a final appeal to the Supreme Court. After sentencing, he can appeal through the state Court system. Convicted felon? Yes. Forever? That is still not a done deal.

(162,888 posts)I am happy that trump is not above the law. The briefs filed by trump's counsel were really sad and ridiculous. Basically it was the position of trump and his attorneys that trump was totally above the law

The high court on Thursday rejected Trumps emergency request to delay the proceeding, setting the stage for him to be sentenced just days before he is inaugurated on January 20 for a second term.
Four conservative justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh said they would have granted Trumps request. Chief Justice John Roberts and Justice Amy Coney Barrett joined the courts three liberals to side against Trump.
Judge Juan Merchan, the New York judge who oversaw Trumps trial, had ordered sentencing in the case for Friday morning but has signaled that Trump will face neither penalties nor prison time.
The sentencing hearing is scheduled for Friday at 9:30 a.m.
In a brief, one-paragraph statement, the court said that some of Trumps concerns could be handled in the ordinary course on appeal. The court also reasoned that the burden sentencing would impose on Trumps responsibilities is relatively insubstantial in light of the trial courts stated intent to impose no penalty.
The fact that trump was so desperate to avoid being sentence makes me happy about this ruling

(22,968 posts)he'll be sentenced in absencia and at some point during his presidency the appeal to SCOTUS of the conviction, based on the "official acts being immune" ruling will lead to the whole thing being thrown out by SCOTUS. Either ACB or Roberts, or both, will switch sides for that ruling.

Amy won't buck Trump a 2nd time.
