Trump hush money sentencing delayed indefinitely

A New York judge Friday indefinitely postponed President-elect Donald Trumps sentencing in his criminal hush money case.
Judge Juan Merchan in a court order also allowed Trumps attorneys to file motions to dismiss the case, in which Trump was found guilty on 34 counts of falsifying business records.
The ruling cancels, for now, the sentencing that was set for next Tuesday.
Prosecutors from the Manhattan District Attorneys Office told Merchan this week that they supported pausing the sentencing date in order to give Trumps lawyers time to argue that the case should be tossed entirely. But the DAs office also said they would oppose that dismissal bid.

If he deports citizens because they criticize him or happen to be the wrong eace, the courts will look the other way. If he declares that we will have no more federal elections, will the courts also look the other way?

NEW YORK, Nov 22 (Reuters) - A New York judge on Friday granted Donald Trump permission to seek dismissal of his hush money criminal case, in which he was found guilty earlier this year, in light of his victory in the Nov. 5 U.S. presidential election.
Trump, 78, had been scheduled to be sentenced on Nov. 26. But prosecutors with Manhattan District Attorney Alvin Bragg's office earlier this week asked New York State Supreme Court Justice Juan Merchan to consider deferring all proceedings in the case until after Trump finishes his four-year presidential term that
begins on Jan. 20.
Lawyers for Trump, a Republican, have argued that the case must be dismissed because having it loom over him while he was president would cause what they called "unconstitutional impediments" to his ability to govern.
Bragg's office said they would argue against dismissal, but agreed Trump deserved time to make his case through written motions.................

(2,440 posts)And more to do with the fact that the vast majority of very rich people write-off nonsense like this frequently and there would then be precedent to go after any and every one of them if this stands. The judge in question didn't want this case and the AG's office received heavy pressure to not pursue this in the first place. He wasn't getting anything other than probation at the sentencing hearing anyway.

Rubin noted there was a key phrase in the document.
"First of all, in calling off the sentencing, Judge Merchan I'm reading from my phone because this is so new that he's ordering that the application for a stay of sentencing is granted and here's the key phrase : 'To the extent that the Nov. 26, '24 date is adjourned.' And then he talks about the briefing for the motion to dismiss, saying he'll take a brief from them on Dec. 2nd and opposition from the D.A.'s office on Dec. 9th."
Rubin then offered an explanation.
"That's the date they proposed to oppose it, what [Trump attorney] Todd Blanche wanted was to put in his opening brief on December 20th," she elaborated. "When you and I were talking about this earlier in the week, I noted to you if that were the deadline, this briefing would likely go into a period of time where former president Trump and President-elect Trump becomes sitting President Trump. That is unlikely to happen now because what he is saying is 'I will accept no reply briefs,' meaning the briefing will be done in its entirety by December 9th and I'm expecting to make some form of decision on this motion to dismiss, probably before the holidays if I had to read the tea leaves here from Judge Merchan."
"So again, staying the sentencing only with respect to that existing sentencing date, he's not indefinitely staying. He's just saying I'm calling off the sentencing that was scheduled for next week, and I'll take a briefing, but not on the timeline that you Trump lawyers want."
I believe that the conviction will stand that there will be a sentencing of trump before the inauguration.
