CHARLESTON, WV (WOWK) West Virginia Gov. Jim Justice says according to a Federal Department of Justice press conference Delegate Derrick Evans is facing federal charges of entering a restricted area.
Wednesday, Jan. 6 hundreds of supporters of President Donald Trump broke into the U.S. Capitol building, including newly-elected West Virginia Republican Delegate Derrick Evans. Evans took video of himself and others rushing into the building. The video was deleted later that day.
The video was deleted off his social media page later Wednesday. The footage shows Republican Del. Derrick Evans wearing a helmet and clamoring at the door of the Capitol to breach the building.
The speaker of the House of Delegates, Roger Hanshaw, said Evans will need to answer to his constituents and colleagues about his actions.

ETA: Delegate Evans announces resignation from House of Delegates
CHARLESTON, W.Va. (WSAZ) - Delegate Derrick Evans, who was seen on video with rioters going inside of the Capitol Wednesday, has announced his resignation from the West Virginia House of Delegates according to a spokesperson. The Wayne County Republicans resignation goes into effect immediately.
In a statement, Evans says The past few days have certainly been a difficult time for my family, colleagues and myself, so I feel its best at this point to resign my seat in the House and focus on my personal situation and those I love.
Evans goes on to say, I take full responsibility for my actions, and deeply regret any hurt, pain or embarrassment I may have caused my family, friends, constituents and fellow West Virginians. I hope this action I take today can remove any cloud of distraction from the state Legislature, so my colleagues can get to work in earnest building a brighter future for our state. And more importantly, I hope it helps to begin the healing process, so we can all move forward and come together as One Nation, Under God.

Anyone who took part should be prosecuted to the full extent of the law. Those who incited this insurrection must be brought to justice as well. The sooner this is done, the sooner we can begin to rebuild what Trump and his GOP enablers and corrupt cronies have destroyed. No plea bargains for any of them. This must never happen again.
To that end: Trump and family passports should be frozen. This family will try to escape their fate by leaving the country. They must not be allowed to circumvent the Rule of Law this time.
