Parents of murdered teen Tyler Burns file $5M wrongful death lawsuit
CHEYENNE The parents of 19-year-old Tyler Burns, who was murdered here two years ago by then-16-year-old Phillip Sam, have filed a wrongful death lawsuit against Sam, his mother and her live-in-boyfriend at the time of the shooting two years ago.
The complaint, filed in Laramie County District Court on Sept. 30, says that Dora Sam and Roger Davis knew of Phillip Sams mental and emotional instability but took no steps to prevent his access to the murder weapon, a .40-caliber Ruger KRS40 semiautomatic handgun.
Dora Sam and Roger Davis were well aware that Phillip Sam was mentally and emotionally unstable; that he had a history of bad behavior; that he had been issued citations for fighting and spitting on others; that he was using marijuana; that he had rebelled against his mother and would not listen to her, the lawsuit says.
They knew him to be a person who was happy to fight with someone who wanted to fight; and Dora Sam had considered seeking a court order declaring him to be a Child in Need of Supervision, it continues.
