Affirmative Action Back on the Chopping Block

The Supreme Court agreed http://www.usatoday.com/story/news/nation/2015/06/29/supreme-court-affirmative-action-texas/27676083/ to review another challenge to affirmative action, Fisher v. University of Texas at Austin. "By agreeing to reconsider the policies, the justices served notice that they might overrule the appeals court and rule against the school's limited use of race in admissions." Abigail Fisher, who is white, claimed UT Austin violated the equal protection clause of the Fourteenth Amendment because of the university's racial considerations in admission decisions. In the 2013 ruling, the Supreme Court found that the Appeals Court for the Fifth District erred by not applying strict scrutiny to UT Austin's policies. In another Supreme Court case, the court ruled that individual states can determine whether racial preferences are allowed in university admission decisions. Michigan, California, Florida, Washington, Arizona, Nebraska, Oklahoma, and New Hampshire have all banned affirmative action. _________________________________________
