One-year-old lawsuit against Strava dismissed

"SAN FRANCISCO, CA (BRAIN) — San Francisco judge Marla Miller dismissed the negligence suit filed against Strava almost a year ago by the family of Kim Flint, Jr., earlier this week.

The San Francisco Superior Court ruled for summary judgment, noting that “Mr. Flint assumed the risks of bicycling and that the defendant (Strava) has shown that bicycling is an inherent risky activity.”

Flint, 41, collided with a car and died while speeding on his bike in June 2010. In the lawsuit filed June 18, 2012, his parents alleged that he was using the Strava app, which allows users to record ride times and ranks riders on individual segments, and that it encouraged dangerous behavior while failing to warn cyclists competing for “King of the Mountain” that the road conditions weren’t suited for racing."

1. I wondered how this would turn out.

I remember the discussion when it happened. There's just as much Strava time comparisons going on off road as their are on the asphalt. It's a measurement tool from what I can see.

2. I'm in the minority on this

but I disagree.

I've seen Strava turn my riding group into a bunch of ubercompetitive jerks who piss off drivers and other riders. Upping your game is fine, but we never had a problem with that before.

I don't think any entity has the right to turn public roads into their own race venue without any supervision. I believe they should be held at least partly liable in these cases, much in the same way a bartender can be held liable if they keep pounding drinks into a patron who kills someone on the drive home.
