Chaos: Michigan court rules recount must end, as Federal court rules it must continue

So now what? On the same evening in which Michigan’s Republican Attorney General was publicly celebrating the seeming end of the statewide recount thanks to a ruling from a Michigan state appeals court, those in favor of the recount were celebrating a ruling from a federal appeals court which ruled that the recount must continue. The initially conflicting headlines have now been resolved, as the two courts issued opposite rulings in near simultaneous fashion and created a wave of confusion.

The Federal court did not rule that it must continue. It ruled that the early start was appropriate (given the need to complete in time for electoral votes to be cast) , but that the state courts control whether to recount at all. They explicitly avoided ruling on whether the recounts were appropriate.

It's most likely that the recount will stop tomorrow morning based on the state appeals court ruling and will then be appealed to the MI Supreme Court. I think they're 5-2 Republican, so the chances are not great.

Federal, state courts duel over Michigan’s recount

The dueling court rulings came as recount operations continued in eight Michigan counties, including Ingham County where officials expected to finish Tuesday night after a day and a half of counting ballots.

“In the interim, we will keep recounting,” said Chris Thomas, the state’s elections director.

Mark Brewer, a Southfield attorney representing Stein, noted neither the state or federal appeals courts ordered the recount to stop, suggesting the state Board of Canvassers cannot do so either.

The board is scheduled to meet at 9:30 a.m. Wednesday.

It all seems so fishy and fraught with vote tampering and suppression. I doubt we'll ever get to the bottom of it.

"The panel of judges on Michigan’s Court of Appeals accepted Schuette’s and Trump’s arguments that Stein, who came in a distant fourth place in Michigan, was not an “aggrieved” party with standing to challenge the election results.

At the same time, the judges appeared to acknowledge that their order would not take effect in light of Goldsmith’s original ruling, the Detroit Free Press reported.

The challenge to the recount will now head back to Goldsmith."
