Only the DOJ could bring charges of treason against Trump, McConnell*, Giuliani or Comey. After Trump is sworn in only Congress can impeach and convict him.
*As for McConnell I am fairly certain the DOJ can charge him, although he MIGHT be covered by his position as a Senator, however I don't give enough of a shit to bother researching the legal issues.

And keep in mind that in the past, they have claimed to have filed "charges" or a "complaint" when in fact all they've done is sent a letter requesting an investigation.
