Harry talks with constitutional and election law expert Matt Seligman about the post-election landscape and the different opportunities it provides for Trump to make mischief. The pre-election landscape has been fairly quiet, though a couple decisions of the Supreme Court may lay the groundwork for possible court intervention in the six weeks after November 5.
The lessons of 2020, the new Electoral Count Act, and the officials on the ground in the swing states all provide some measure of reassurance; but theres no doubt that the Trump forces are preparing to sow chaos and advance dubious claims. The critical stretch will be from the end of the counting until December 11, when the states must certify their votes. A brief window for litigation follows, and that window shuts, and in theory the result is set, as of 12/17, when the electoral college meets.
