5. They were already torturing him in a sense by prosecuting him on charges

that normally don't get prosecuted. But it wouldn't have stopped. They'd have kept "investigating" him, trying to get something on him, harassing him for the specific purpose of breaking his sobriety in the hope that he'd commit another crime - however minor - or maybe OD. Anything to crush him and by extension his father.
