11. there's relevant precedent when Gerald Walpin was fired back in 2009

Obama put Walpin on administrative leave and gave notice to Congress. Walpin challenged it in court but Obama's decision was upheld.

Seemingly the only difference in facts between the two (aside from the obviously immorality exercised by the orange mound) is that Obama gave proper 30 day notice.

It's deja vu because many of the same players are involved (Eisen, Grassley, etc.). Good reading if you want to look at factors the court would likely consider.
