He is also charged with not listing his drug use on a firearm purchase application. People don't go to prison when charged with this alone. If they did a third of the population of many Southern and Western states would be in prison.
These are political prosecutions. Merrick Garland should explain to the people of the US that they are political prosecutions. Then President Biden should pardon him.

(44,862 posts)As numerous DUers have posted numerous times, the SCOTUS immunity decision does not mean a president "can do what he wants". It means he can't be criminally prosecuted for doing something illegal. It doesn't make something illegal into something legal. It doesn't prevent the courts from reversing or enjoining an illegal action nor does it mean that the many government employees that would have to play a role in carrying out an unlawful presidential directive would do so.
That being said, he doesn't need the immunity decision to "pardon everyone" because his pardoning people is a presidential power conferred on him by the Constitution.

When Gerald R. Ford took the oath of office on August 9, 1974 as our 38th President, he declared, I assume the Presidency under extraordinary circumstances
This made him the only person to become the nation's chief executive without being elected to the presidency or the vice presidency.
And even though he took over for a President that resigned, he is considered the 38th President. So would Harris in the event Biden should resign (which he won't).

And Hunter? Yes, pardon him immediately because it was an unfair political witch-hunt. I'm all for holding everyone accountable, but the motivations and context has to be right. It can't be done to win an election, ESPECIALLY when a coup plotting criminal is about to be sworn in as president.

If that means unorthodox bending or breaking of rules, by all means, do it. After all, SCOTUS said the President can get away with anything as an official act. Maybe it's all the health issues right now going on in our house, and it just hasn't hit me? But, I am calm. Disappointed, but not losing my shit. Delayed reaction coming maybe... once my hernia is repaired, sister's aneurysm is evaluated. Oldest sister's heart valve basically completely blocked, she's opted for no surgery. Sigh

(44,862 posts)The president can't "fire" Supreme Court justices. The only way they can be removed is through impeachment and conviction. And, no, the immunity decision doesn't allow the President to remove them. It merely means that if he tried and doing so violated some criminal law, he couldn't be prosecuted. But his action would still be unconstitutional and unlawful act and would be nullified by the courts in a nanosecond.

They could be locked out and bellow about it to the press.
And, what courts do you suggest would supersede the remaining supreme court?

Which is why it your suggestion is one of the more ridiculous things I've seen posted on DU in my 20 years here. Sorry if that sounds harsh, but its true.

What supreme court ruling is going to approve of the removal of supreme court justices? If five justices were removed, the remaining justices wouldn't even have a quorum to act, but if they did and could, they would unanimously uphold the constitution by ruling that any attempt to summarily remove supreme court justices is unconstitutional.

How could we get someone to propose this to him? He's tough. He can hack the comments. He was a good President. If there is some action that he wants to do but is hesitant to do, something to do with his new power, he could pass it to Kamala and she could do it. Let her issue a few hundred thousand EOs for Trump and his buddies to work through.

(7,340 posts)Trump et al. started talking about executing his enemies. And, what does discussing a pardon for Hunter have to do with trashing President Biden? Why would Joe changing his mind in a changing milieu not be realistic?
Regardless, it's not a bad idea to have Kamala do it for him. If he doesn't have it in him to do harsh things, resign and let her do it. His character is not in question, and no one has said it is. Kamala didn't make the statement. Her character is also not in question.
In fact, he should pardon everyone in sight. Also, he needs to do the EO thing. Close as many loopholes and pathways as he can. I know how you feel regarding inaccurate info on the new Presidential power, but Biden can do something, change some governmental infrastructure, do something! Tie it up in a giant ball of string and keep Trump et al. busy for 2-4 years.

So maybe trashing was too harsh, but the point is that folks should let go of this idea and move on. Joe's not going to do it.
