Now that Matt Gaetz resigned from Congress, can he now be charged and arrested for his crimes?

His cohort is sitting behind bars correct? Being in Congress shielded him I thought? The House ethics investigation was due out this week!

They have to show some nut-power and ask for the report from the committee that investigated Gaetz. The report was due to come out on Friday. So this appointment to Attorney General, may all be an American style Kabuki Dance.

Yes, members of Congress can be arrested, but they have some protections from arrest:

Privilege from arrest
Members of Congress are generally protected from arrest while attending their respective houses of Congress, traveling to and from Congress, and during speech or debate. However, they can be arrested for treason, felony, or breach of the peace. The Supreme Court has interpreted the phrase "breach of the peace" to include all criminal offenses.

is not the same as being immune from prosecution based on his status as a member of congress.
