It is now up to Congress to vote, by a 2/3 majority, to allow him to become President, otherwise he cannot become President, and Vance becomes Acting President according to Section 3 of the 20th Amendment.
It is preordained.

The US Supreme Court has ruled that individual states dont have authority to keep former President Donald Trump off the ballot in the 2024 presidential election. The Court said that the role of giving effect to Section 3 of the 14th Amendment to the US Constitution under which Trump had been disqualified from standing in Colorado continues to lie with Congress.
The decision paves the way for the former President to stand for election in November despite four ongoing criminal cases pending against him and lingering concern over his role in the 6 January 2021 attack by his supporters on the US Capitol. The only other challenger left in the Republican presidential nomination field, former South Carolina governor Nikki Haley, resigned from the contest on 6 March.
In a rare unanimous decision, the nine Supreme Court justices ruled on 4 March that the state of Colorado didnt have authority to prohibit Trump from standing for national office. A group of voters in Colorado had sought to disqualify Trump under Section 3 of the 14th Amendment to the US Constitution because, they alleged, he had committed insurrection against the government he was sworn to serve.
This is one of those rare, unanimous opinions. And thats in part because of the concern for there being a patchwork of disenfranchisement if they were to rule in favour of Colorado. There was probably also a little undercurrent of the need to show some unity and not divide on political lines, says Laura Prather, Scholarship Officer for the IBA North American Regional Forum and a partner at law firm Haynes Boone in Austin, Texas.

It is now up to Congress to vote, by a 2/3 majority, to allow him to become President, otherwise he cannot become President, and Vance becomes Acting President according to Section 3 of the 20th Amendment.
While it would help if Congress voted by less than 2/3 (i.e. failed) to allow Trump to become President, Trump cannot become president until his disability is removed.
Colorado didn't stop Trump from running for election, but they made a judgement. When the Chief Justice shows Trump the judgement of Congress and the judgement of Colorado, then refuses to administer the oath of office to Trump, we will know whether he will uphold the Constitution, or uphold Trump the autocrat.

According to the unanimous SCOTUS ruling, only Congress can disqualify him (or remove that sanction) under the 14th Amendment.
Even IF we posit that a conviction for insurrection (obviously such a conviction would have to be upheld by the SCOTUS) was enough to bar him from office (unless Congress, by a 2/3rds majority, removes that sanction) is enough to bar him, the simple fact remains that he never was legally convicted of insurrection.

(7,682 posts)The Supreme Court has ruled on this and said that Section 3 does not apply until after Section 5 requirements have been met. Here is a link that explains it all. Not mentioned are the laws Congress passed in the late 19th century that attempted to address Section 5 requirements, perhaps because they were too specific and thus did not specifically address the Office of the President of the United States.

Will the members of Congress, who were victims of the Jan. 6, 2021 insurrection at the Capitol, be concerned by the absence of Trump's conviction for the insurrection, when they vote in conformance with Section 3 of the 14th Amendment, to allow Trump to overcome his disability of engaging in the insurrection, to then become President again?
I say yes, which means Trump must also be arrested for inciting the insurrection, by the US Attorney General, simultaneously with the Chief Justice notifying Trump, in a pro forma manner, that he is disqualified from being President, otherwise Vance will let Trump, as a non-presidential free man in Mar-a-Lago, gleefully run everything into the ground. Don't tell Vance.
Otherwise, if Congress fails to have a "vote to allow", then they and us, will have to struggle against Trump, his dingbat unqualified cabinet members, his scheming regulators, his allied billionaires, and daily news-media alerts, as they purposefully tear the government down, according to one vengeful autocrat's whims over the next few years, with resistance based on whatever remains of our Constitution.
Trump doesn't like the rules setup by Congress under the Constitution, so he violates both of them with impunity, and they let him, due to fear/loyalty of half of Congress.

Example: If local cops and MAGA vigilantes want to round up immigrants, I will be looking for ways to hide them or smuggle them to safe places while smiling at the MAGAs when face to face with them.
