it didn't have to be "dismissed." It could have simply been delayed until he left office.

meaning that it could be resurrected when he leaves office (assuming the controlling statutes of limitation are tolled for that period). But that still doesn't get around the SCOTUS immunity decision.

at DOJ. Why didn't they bring him to trial NOW. Why did they not do it BEFORE the election was over? nothing anyone can say will make me believe that all the actions from day one were ok.

But by doing it this way DOJ had a chance to "tidy up" all the loose ends and leave this case sitting there in case anyone in the future ever wants to take it up. If Smith had allowed himself to be fired on Jan 20th, the case would have been left is disarray and likely been unsalvageable.

That being said I doubt we ever hear from this case ever again, because drumpf has been given all the tools he needs to consolidate power for the rest of his life.

make no mistake by my comment, i am absolutely furious that drumpf got away with trying to overthrow the government. and we are all going to suffer now for that failure combined with an ignorant and selfish electorate that cares more about the illusion of cheaper eggs than they do having a democracy going forward.

It's the DOJ standing policy on not indicting a sitting President. The Biden DOJ had the opportunity to revisit the OLC opinion that governed this in 2021 and 2022, but they declined to do so.
