Law is not an impediment for a prosecutor on a mission.

Back in 2019, a Trump-appointed U.S. attorney indicted a Massachusetts judge on obstruction charges, which are extremely broad under federal law, when she took steps to prevent ICE from arresting an undocumented immigrant in her courthouse.

Whatever a border czar is, they don't have arrest authority. Federal law enforcement officers do, pending judicial enforcement. Consultation with prosecutors is the norm for pre-planned arrests & here's the kicker: people being arrested must have actually committed a crime.
