Would Kash Patel have immunity if you were arrested for merely

speaking out against Donald Trump (e.g., MSM, newspaper, blog, etc.) and you wanted to sue for false arrest and malicious prosecution?

1. Kash Patel has no immunity if he acts in a manner unconstitutional. However, TSF would pardon him.

Qualified immunity that holds for law enforcement does not include acts that are in violation of the constitution so the overarching answer is no. But, Trump will do as he pleases and the courts grind slowly.
