out of court for failure to state a claim upon which relief can be granted. Right of publicity/persona is a state right - and not all recognize it. In 14 states, there is no law prohibiting it - so suing in those states would get the claim tossed. In the other 36 states there is a lot of variation in the details of the law.

It's not the dollar amount that matters. It's the principle that you cannot make your own rules and get away with it. And it's not just correct for me. There are laws on the books for situations just like this.

Doubt FLOTUS chose her seat. It is not evident to me that she is smiling at Trump. She may be looking past him or she may be being polite. The implication of the ad’s statement is unconscionable.
