Please call or write your Senators today to help pass The Social Security Fairness Act (H.R. 82)

The Social Security Fairness Act (H.R. 82), will repeal the Windfall Elimination Provision (WEP) and the Government Pension Offset (GPO).
This bi-partisan measure has already passed the House.

Social Security Fairness Act of 2023

This bill repeals provisions that reduce Social Security benefits for individuals who receive other benefits, such as a pension from a state or local government.

The bill eliminates the government pension offset, which in various instances reduces Social Security benefits for spouses, widows, and widowers who also receive government pensions of their own.

The bill also eliminates the windfall elimination provision, which in some instances reduces Social Security benefits for individuals who also receive a pension or disability benefit from an employer that did not withhold Social Security taxes.

The repeal will help people who have had their Social Security cut by WEP and Government Pension Offset.

I worked 23 years in social security jobs then 21 years in state government before I retired. I was shocked to hear that my social security would be reduced by about 50%. For 23 years of employment I receive $360 in social security once I pay for Medicare. I just hope this inequity is resolved. I’m not holding my breath though.

The bill will be voted on tomorrow. Little doubt now it will pass the Senate and go to President Biden's desk for his signature. It's a long time coming. I will get around $120 a month increase in my SS benefits.

You never know, but it passage certainly looks good at this point.


They are debating various amendments in order to kill the legislation.

From the SS Fairness FB page:
Proposed amendments:
Sen. Mike Crapo (R-ID) to require repeal to be paid for prior to taking effect.
Sen. Ted Cruz (R-TX) to strip the repeal language from the bill and replace with a WEP-only proportional formula change.
Sen. Chuck Grassley (R-IA) to impose mandatory Social Security on all public sector employees (not sure if this is just for new hires or current workers as well) as an offset to the cost of repeal.
Sen. Rand Paul (R-KY) to raise the Social Security retirement age to 70 to pay for repeal.
All of these are poison pill amendments and if any of them are approved, they will effectively kill the bill. NAPO is urging Senators to VOTE NO on all amendments and YES on final passage of H.R. 82. Please continue to press your Senators to vote no on all amendments and vote yes on final passage of H.R. 82. Together we will get this across the finish line


Grassley's amendment cannot be law because the US Constitution prohibits the federal government levying taxes on state and local governments.
FICA is a tax. Originally, public sector employees were not eligible for SS at all; it started to change in the 1950s. States and municipalities can opt into paying into the system, but they cannot be REQUIRED to.

These amendments are all poison pills to kill the legislation.
