Judge Boasberg Rejects Trump Administration's Effort to Rescind Restraining Order on Venezuelan Deportations
In a ruling handed down minutes ago, U.S. District Judge James Boasberg has rejected the Trump administration's request to lift a restraining order that had been imposed on the deportation of Venezuelan nationals under the Alien Enemies Act (AEA).
Boasberg ruled that the Venezuelans marked for deportation are likely to succeed in their claims, as they are entitled to individual hearings and due process before being removed from the U.S. The Trump Administration had previously sought to deport these individuals without any hearing.
While acknowledging that the Trump administration is afforded considerable deference in invoking the AEA, Boasberg emphasized that deportees must have an opportunity to argue against their removal.
The judge pointed out that these individuals should be able to contest their inclusion in the deportation list and, importantly, have the chance to challenge their potential incarceration in El Salvador, a country where they face a "likelihood of potential torture."
