The Trump administration is asking the Supreme Court to intervene in the Alien Enemies Act case and vacate a judge's ruling barring deportations under the rarely-used wartime power.
“This case presents fundamental questions about who decides how to conduct sensitive national-security-related operations in this country—the President, through Article II, or the Judiciary, through TROs. The Constitution supplies a clear answer: the President,” Solicitor General Sarah Harris wrote. “The republic cannot afford a different choice.”
It also asks the high court for an administrative stay of U.S. District Court Judge James Boasberg's temporary restraining order halting the flights while it considers the appeal ...
The high court asked the plaintiffs in the case to respond to the filing by Tuesday.
