Even for a far-right partisan like Oldham, this opinion is shocking. It suggests that Biden’s commutation is somehow illegitimate because it doesn’t fit in the “tradition” of clemency, or because Biden allegedly didn’t know he was signing it.

The only reason Judge Oldham would cite reports that Biden signed commutations with autopen, along with speculation that he lacked understanding of his actions, is to fuel deranged conspiracy theories promoted by the fringe-right that Biden’s clemency is illegitimate. This is totally out of bounds.
Oldham makes it sound as though Biden never gave a reason for his death penalty commutations, presumably to promote the broader implication that he didn’t even know he was doing it. Another inaccuracy: Oldham says that Biden pardoned this defendant. That’s objectively false! Biden merely commuted his sentence from death to life in prison. This man will die behind bars. Oldham seems to be lying about this fact to incite outrageous against Biden. Utterly imprudent and offensive.
