Lawyers for former President Donald Trump on Thursday asked the judge in his Jan. 6 prosecution to keep a stay in place for a month so that the defense and special counsel Jack Smith can file their immunity appendices at the same time after the 2024 election has come and gone.
On Oct. 10, several days after Smiths immunity brief went public, U.S. District Judge Tanya Chutkan ruled that the prosecutions redacted appendix should also go public since Trumps concern with the political consequences of these proceedings is not a cognizable legal prejudice. At the same time, the judge stayed her order and gave Trumps team seven days to evaluate litigation options.
The defense argued that a stay extension would promote public confidence in the integrity of these proceedings and a courts duty to remain apolitical, similar to an argument that was made in favor of pushing back sentencing in Trumps hush-money case.
Obama administration and Jan. 6 Committee attorney Eric Columbus, for one, saw the filing as a prelude to Trump lawyers asking the U.S. Supreme Court to get involved again.

(465 posts)Another manifestly frivolous Motion soon to be denied by Judge Chutkan. I hope that this time Judge Chutkan "sanctions" these asshole lawyers. When Federal Judge Middlebrooks in Florida sanctioned the Turd and Alina Habba $975,000 "jointly and severally" that stopped their filing of frivolous litigation matters.

(2,457 posts)What is to be released we already know - its the interviews with every cabinet member and aid who told him a)there was no widespread fraud which would have changed the election and b)Trump lost.
This completely undermines his entire campaign and every (R) talking head that wants to ignore his continued bs about the last election and pretend that, at minimum, "there were questions/problems" as they try to phrase it now.

Trump objected to the public release of the Special Counsels filings, arguing that it would prejudice potential jurors, endanger potential witnesses, and irreparably harm him, especially given the proximity to the Presidential election.
On October 2, 2024, the Court overruled Trumps objections and ordered the immediate public release of the Special Counsels redacted immunity brief, which led to significant media coverage and political use by the incumbent Vice President.
Trump argues that releasing both appendices simultaneously would provide a more balanced view to the public and potential jurors, reducing the risk of prejudice and harm.
Trump emphasizes that the public interest and the integrity of the ongoing election would be better served by a temporary stay, ensuring that the case does not unduly interfere with or appear to interfere with the election.
Trump is full of shit as always.
