Steve Bannon believes Americans are "about to see a war in the Senate," telling Newsweek on Saturday that some Democrats in the upper chamber "want to have an actual Blitzkrieg of federal judges approved," prior to President-elect Donald Trump taking office in January.
In a phone interview with Newsweek early Saturday afternoon, Bannon spoke about the transition period between President Joe Biden and the Democratic-majority Senate to Trump and the newly elected Republican majority Senate.
Following Trump's electoral victory earlier this week, in which he won both the popular vote and the Electoral College, there have been various calls on social media as well as, according to NBC News reporter Sahil Kapur "one official in the Biden administration," urging U.S. Supreme Court Justice Sonia Sotomayor to resign from the bench so that Biden, with support from the Senate, would be able to appoint a new justice ahead of Trump's second term. Newsweek has reached out to the White House press office for comment via email on Saturday afternoon.
Sotomayor, who was appointed by President Barack Obama in 2009, is the first Latina and the third woman to serve on the Court. At 70, she is the oldest Democrat-appointed justice on the Court, which has a 6-3 conservative supermajority. Conservative Justice Clarence Thomas, who is 76 years old, is the oldest sitting member of the Court.

TSF got off lock, stock, and barrel.

(143,018 posts)The NY State version of the federal fraud case that Bannon was pardoned for.
As a note, the state of NY has so far been the ONLY entity to convict 45 or find him liable for both criminal (hush money/election fraud) AND civil (his Organization's fraud, E. Jean Carroll sexual assault, defamation) crimes.

(1,561 posts)there is no double jeopardy for the state trial (at least per the lawyers at legal AF).
So little to enjoy with real accountability for these sociopaths, Im going to savor this trial. Let TSF stew about it all he wants.
I hope his name comes up many times and MAGAs, at least a few, wake up to the grift that was and will continue.

Attorney General James Applauds Signing of Double Jeopardy Law
NEW YORK Attorney General Letitia James applauded todays signing of a new law to close New Yorks double jeopardy loophole. The law addresses an unintended loophole in New Yorks double jeopardy protections that could deny the state the ability to pursue justice in cases where the president has used his or her pardon power for corrupt purposes. The new law, which was introduced by Attorney General James, takes effect immediately.
We have a responsibility to ensure that individuals who commit crimes under New York state law are held accountable for those crimes, said Attorney General Letitia James. This critical new law closes a gaping loophole that could have allowed any president to abuse the presidential pardon power by unfairly granting a pardon to a family member or close associate and possibly allow that individual to evade justice altogether. No one is above the law, and this commonsense measure will provide a reasonable and necessary check on presidential power today and for all presidents to come.

(1,561 posts)they would rule it was double jeopardy. I havent heard what any DOJ attorneys have opined on the topic.
Thankfully it doesnt apply here so his team wont have that argument at appeal.
But if whatever sentence he gets is stayed for appeal and that appeal takes as long as his last one Ill be $%*#

(143,018 posts)and was pardoned "federally" for those charges. And I think the "pardoned" thing is what the NY law was focusing on because it basically says the previous charges would have been "wiped", so there were no "charges", and the person would now "start over with a clean slate" allowing new charges (in this case for violations of state law), if it ever came to that.
And I agree about how the state courts might still handle this although the NY courts allowed 45's charges to go all the way to the sentencing (which was delayed for the election). So I can't see how they would punt on Bannon, who was not running for nor elected to any office.

(143,018 posts)Some have been in confirmation hearings and waiting for that to complete and/or get voted out to the floor and others are getting scheduled for votes.
As a ballpark set of numbers, the below from here - https://www.huffpost.com/entry/senate-democrats-lame-duck-biden-judges_n_672e58e2e4b0933e82c9ed15
Seventeen of Bidens pending judicial nominees are currently waiting for a vote on the Senate floor and eight are waiting to be reported out of the Senate Judiciary Committee. Three more are waiting for a committee hearing.
Schumer and Sen. Dick Durbin (D-Ill.), who is chairman of the Senate Judiciary Committee and the Senate majority whip, will decide how Democrats proceed. HuffPost reached out to both to get a sense of how aggressive theyll be with moving Bidens final batch of judges.
We have two teed up for next week, is all that Schumers spokesperson, Alex Nguyen, said.
Sen. Durbin aims to confirm every possible judicial nominee before the end of this Congress plain and simple, said Durbin spokesperson Emily Hampsten. We will continue to hold nominations hearings and markups to move nominees through the Committee. He doesnt set the floor schedule, but will be pushing, as he has been for the past four years, to prioritize time for judges.
(snip)
So far, Biden has had 213 Article III Judges (including one SCOTUS) confirmed. There are enough pending for a vote and release from Committee to the floor for a vote, who if voted on favorably, can surpass 45's last minute flurry before he left office in 2020 (where he had a total of 234 thanks to Turtle jamming them through).
