A New York judge delayed plans on Tuesday to decide whether President-elect Trumps conviction can withstand the Supreme Courts presidential immunity ruling, following his election victory last week.
In an email to Manhattan prosecutors and Trumps attorneys, Judge Juan Merchan said he would freeze the case until Nov. 19. Prosecutors are due to provide by then an update on what they believe are the appropriate next steps now that he is president-elect.
Trumps sentencing, which would be the first of any former president, is scheduled for Nov. 26. He was convicted on 34 felony counts of falsifying business records in connection with a hush money payment made to adult film actress Stormy Daniels ahead of the 2016 election to conceal an affair, which he denies.
Trumps attorneys believe his election as president compels the dismissal of his criminal prosecutions.

Why isn't the state of NY being held accountable?

(27,767 posts)You aren't technically a convicted felon when the jury votes "guilty". It's when the judge signs the final order implementing the sentencing.
If sentencing never happens - he isn't a convicted felon.

Let it go to the SCOTUS and see if they think they have oversight of ESTABLISHED STATE law.
Its going to happen again so the law should be established. We need this to to set precedent.
