President-elect Trump has started receiving intelligence briefings

Source: NBC News

Nov. 19, 2024, 2:02 PM EST

President-elect Donald Trump is now receiving intelligence briefings after having declined them during his campaign, according to a source with knowledge of the matter and a former U.S. official. The briefings from the Office of the Director of National Intelligence (ODNI) began shortly after the election, in keeping with a custom launched by President Harry Truman at the end of his tenure, the sources said.

“ODNI is acting consistent with the tradition, in place since 1952, of providing intelligence briefings to the President-elect,” an ODNI spokesperson said. The office would not comment specifically on whether Trump was actually accepting the offer of the briefings. The Washington Post first reported on the briefings.

A Trump transition team representative was not able to confirm that Trump had begun receiving the briefings. Before the election, Trump had said he did not want to get the intelligence briefings to avoid any chance he would be accused of leaking information.

In 1952, Truman ordered that intelligence briefings be made available to presidential nominees and presidents-elect to ensure a smooth transition of power and to prepare a prospective commander in chief for office. The briefings are not required by law.

That is the "Raw Story" version but I actually saw it mentioned on a different site this morning that I was trying to find (I was not on Raw Story). I think the sites with this info were quoting Jonathan Lemire from MSNBC this morning. He actually hosts the show before Mourning Schmoe so not sure if it came from his show or Schmoe's show.

He's proven he's a danger to national security, so he might just slip up and provide the evidence the Defense Department needs -- and commander-in-chief Biden, for that matter -- to legally justify withholding anything but lowest level classified intel from him for the duration of his administration.

(Standard Form 86). Their access to classified information is based on their positions. Their non-elected or non-senate conformed judicial staff positions are subject to the normal federal government security clearance process.

The Federal Government also extends some classified access to state, tribal and local officials.

investigation. For Presidential appointees, it usually has been the FBI.

Following the investigation, an authorized official adjudicates the investigation and grants or denies a level of clearance (Confidential/Secret/Top Secret), or denies a clearance. In addition to a clearance being granted, the individual may or may not be granted access to additional categories of information, such as Restricted Data, Sensitive Compartmented Information, and/or non-SCI Special Access Programs.

The Executive Branch has great latitude in granting clearances and accesses, including to Congressional and Judicial Staff personnel (but not to members and Article III Justices/Judges). Unless overruled by the DNI or President, NSA, CIA, and NGA can deny access to agency sub-compartmented programs.

NSA and CIA also require successful polygraphs for access to some of their information. Everyone takes a full lifestyle (personal conduct) test and counterintelligence (CI) tests except military personnel assigned to NSA, who take only the CI poly.

But if he was willing to forgo the carrot (office space, funding, etc.) - then there was never much of a "stick" in the Presidential Transition Act. And the incoming president receiving briefings predates the law anyway. It was always unlikely that this would change
