Harry Litman - State Secrets or State Coverup?

Hi everyone,

Yesterday the administration played what is typically the ultimate trump card in litigation. It invoked the so-called “State Secrets Doctrine” to attempt to shut down Judge Jeb Boasberg’s campaign to get certain information from them. The information—much of which already has been made public—concerns their actions on the evening of Saturday, March 15th, when Boasberg, in an emergency hearing, ordered them not to deport alleged members of Tren de Aragua to a maximum-security prison in El Salvador.

The invocation was preceded by a week-long tug-of-war in which the administration repeatedly played it too cute by half or simply stonewalled an increasingly exasperated Boasberg. The administration trotted out various justifications for its evasions, including chastising Boasberg for pursuing a “picayune” dispute and “beating a dead horse.”

But after two of three rounds of evasion and non-responses, the administration first mentioned the possibility of the State Secrets Doctrine. Boasberg reasonably insisted that they tell him one way or another if they were going to use it. The next day, the administration filed yet another non-responsive brief, adding that it hadn't been able to determine whether to apply the State Secrets Doctrine. Boasberg pronounced their submission “woefully insufficient,” as it was, and accused the administration of evading their obligation to comply with the court order, as they were.
