Totally get your frustration. Groundwater issues are a nightmare. HOA's power can be overwhelming. Instead of hiring a contractor who might worsen the situation, pursuing legal action could have been more straightforward. Now, the financial uncertainty is a big risk. Better planning could have saved a lot of hassle.

Groundwater, foundations waterlogged, softening soil. It's a community sitting on a lake.

HOA's usually win everything, sort of a private mutual contractual eminent domain.

Why hire a contractor to make the problem worse instead of just suing for use of her property? Monetarily could have been worked out. Now the costs are unknown.

How is a fine going to get the drainage problem repaired? Fix the problem and send her the bill. If she doesn't pay it, jail her ass for a few years.
She has to be a republican. Just guessin' here. Only my opinion.

HOA communities typically have rights-of-way along property borders for utilities installations -- including stormwater drains.

Wouldn't be surprised if a few homeowners end up suing her for water damage to their properties for her arrogant stupidity.
