Benson asks high court for emergency ruling on RFK Jr. being on Michigan ballot

The Michigan Court of Appeals on Friday ordered former independent presidential candidate Robert F. Kennedy Jr.'s name removed from the November ballot, prompting the Secretary of State's office to seek an emergency decision from the state Supreme Court.

The unanimous ruling by the appeals court could affect what's expected to be a close presidential race in Michigan and followed Kennedy's appeal of a lower court order that would have kept him on the state's ballot despite his withdrawal from the race and recent endorsement of Republican Donald Trump.

"While the request was made close to the deadline for defendant to give notice of candidates to local election officials, it was not made so late that laches should apply," wrote the three-judge Court of Appeals panel, referring to a legal doctrine that lets a court deny relief because a claimant delayed making their claim.

"Additionally, we conclude that the absence of any statutory authority prohibiting his withdrawal gave plaintiff a clear legal right to have his name removed from the ballot."
