NYPD memo tells officers not to stop New Yorkers smoking marijuana in public

A recent memorandum from the New York Police Department (NYPD) advises officers not to stop residents who are smoking marijuana in public.

The memo shared with The Hill on Friday outlines how officers are to approach the drug after New York Gov. Andrew Cuomo (D) signed recreational weed into law for adults aged 21 and over on Wednesday.

Under the law, residents can have up to three ounces of cannabis and 24 grams of cannabis concentrate on them outside of their homes.

The memo was first reported by CNN on Thursday.

This could force a contact high on other people, even children. And some people are especially bothered by the smell. No one should smoke anything in public, in my opinion.

Not a smoker but they do have the same rights as anyone else. It ends when it encroaches on yours. I think it should be declassified as a class 4 drug down to 1 or 2 so it can be studied. I am not sure how outdoors a contact high would be possible. We should use science to establish this.

I have been to many outdoor concerts and while you could smell and see it, never did I feel a psycho active effect. I tried to inhale it as much as possible so it wasn’t for lack of effort. I am sure second hand smoke is not good for you but air pollution is a bigger killer than smoking.

When I lived in California, we had to keep our house closed up one summer with no air conditioning because some very selfish people in our neighborhood would sit in their cars and homes, and blow a ton of pot smoke out the windows, where it would drift into our house if anything was open. My wife has a bad reaction to pot smoke and we had a baby daughter that we didn’t want to expose to the smoke. We couldn’t stop the jerks from being jerks, so we just had to suffer in the heat.

Your right to swing your fist should stop at my face. If you live in a place where you have a right to not wear a mask in public, that doesn’t make it a moral decision. Likewise, having the right to blow pot smoke at other people doesn’t make it an ethical thing to do.

That population seems to grow more and more. Not sure when you lived in CA but my experience renting around the Bay Area post year 2000 was no smoking in doors or patios. I rented about 4 years before a house fit. The rental agreement made no smoking an objective that if violated they could and would do an eviction (2 months of rent deposit became theirs too-they were very motivated to monitor it).

I don't think you would run into the same circumstances again. If you complained they would act upon it. It is nasty but if they can do it in a far away designated area - sure let's give them some where.

used as justification to harass black and brown folks, throw them in jail and ruin their lives as well as their families' lives.
I'm not even sure smoking in public is a thing. But I am glad they don't have this ready made excuse anymore.

Fellow NYer here born and bred. 100% legalization but the legislature got a few things wrong and hope they will correct them in the future.
