A federal judge is upholding the victory of western Pennsylvania Democratic State Senator Jim Brewster.
The judge ruled that mail-in ballots that did not have dates could be counted in Allegheny County.
The battle over the election between State Senator Brewster and Republican challenger Nicole Ziccarrelli led to tempers flaring in the Pennsylvania Senate last week.
Republicans refused to seat State Senator Brewster last week over the election challenge.
State Senate President Pro-Tem Jake Corman said he would seat State Senator Brewster if the court allowed those votes to be counted.

(35,666 posts)Jim Brewster won the election to the 45th Senatorial District seat by only 69 votes. The controversy stems from the fact that in Allegheny County, mail-in ballots that were missing the hand-written date on the envelope were counted. However similar mail-in ballots from Westmoreland County were not counted.
The PA Supreme Court has already ruled Jim Brewster the winner, now it has been seconded by U.S. District Judge J. Nicholas Ranjan.
