Plastic bag ban voted down by Memphis City Council

A citywide plastic bag ban that would have tested a state law forbidding such limitation by local governments was voted down by the Memphis City Council.

The vote Tuesday, on third and final reading, followed an earlier proposal to implement a plastic bag fee starting with the city’s biggest retailers. Council member Berlin Boyd sponsored the proposal.

The state law was passed before the council completed votes on three readings of the measure, and Boyd responded with the proposed ban.

Boyd said his intent with passage of a ban was to get a legal opinion from the Tennessee Attorney General or an exemption from the state law from the Legislature.
