EEOC claims CSX hiring practice discriminates against women
The U.S. Equal Employment Opportunity Commission claims officials at CSX Transportation in Huntington are engaging in unlawful employment practices that discriminate against women, according to a lawsuit the commission filed in federal court Tuesday.
At issue are the physical capability tests administered to CSX applicants, which exclude women from gaining employment at the facility, the commissions lawyers said in the complaint filed in U.S. District Court in the Southern District of West Virginia.
In the complaint, the commissions lawyers claim Amanda Hutchinson was awarded a position at CSX, but she later was excluded due to her performance in the physical capability test that CSX requires for employment at that facility.
Commission lawyers said the physical exam requirement is a violation of Title VII of the Civil Rights Act of 1964. Among other rights to gain access to employment, the language of that section provides employers cannot fire or deny a job to a person, or limit a persons classification or status as an employee, based on their race, color, religion, sex or national origin, according to the commissions website.
