[Senator Barry] Goldwater’s mandate flowed from an election that he won in the state of Arizona, and that electoral victory gave him the constitutional legitimacy, if not necessarily the moral right, to cast a vote against civil rights. The same cannot be said about the justices of the Supreme Court, however. Justices are not elected, and their mandate flows from the Constitution’s text and their duty to interpret it in good faith.
