In 1987, however, the federal appeals court in Atlanta overturned the Hand ruling. The appellate judges said that "we need not attempt" to decide whether secular humanism is a religion, because even if it is, the parents had not proved that the schoolbooks unconstitutionally established it. While noting that "the textbooks contain ideas that are consistent with secular humanism," the judges stressed that "mere consistency with religious tenets is insufficient to constitute unconstitutional advancement of religion." The First Amendment bars a state from erecting a Secular Humanism Cathedral but not from teaching evolution in the public schools – just as it bars a state from erecting a Christian Cathedral but not from enforcing "Thou shalt not kill" through the criminal laws.
