(WASHINGTON) After a lengthy legal battle at the National Labor Relations Board (NLRB), the Teamsters are celebrating a landmark victory with its decision in the case of Cemex Construction Materials Pacific, LLC (28-CA-230115). The labor board ordered Cemex to bargain with the Teamsters in a precedent-setting move, thereby ruling that all employers will now be required to bargain with a union if, during an election for representation, the employer commits labor law violations egregious enough to compromise the legitimacy of the results.
This landmark decision by the NLRB will be a catalyst for workers who are standing up and demanding their worth not just at Cemex, but at every other employer in the country, said Teamsters General President Sean M. OBrien.
The way Cemex conducted itself when its workers sought to organize five years ago was on par with the way elections are undertaken in a tin-pot dictatorship, said Chris Griswold, Teamsters International Vice President At-Large and President of Teamsters Joint Council 42. This company fired union supporters, intimidated them, harassed them, and broke nearly every other rule under the sun. If any good came out of this companys scorched-earth thuggery, its that now employers will think twice before they break the law to break the union.
The decision, which also allows the NLRB to implement bargaining orders in other situations where the employers actions impede the ability to hold a fair election, means that the board will now issue bargaining orders in lieu of re-running elections as a remedy for unlawful union-busting when the union already established majority support. It comes only a day after the NLRB announced a pro-labor regulation, one that ended frivolous procedural hurdles that lead to delay in holding union elections.

(18,389 posts)Im sure it will get appealed, and with cases pending before SCOTUS that could neuter ALL executive branch regulations without specific congressional legislation, this is far from a slam dunk for workers, but its still an important step.

(7,856 posts)(as well as everything else I have been reading on this topic), this was a decision by the NLRB, not by a Court. I doubt whether they can appeal directly to a court. Of course what they can do is file alawsuit in court - and once begun, that can be appealed as high as it gets, so it'smerely an additional step. But we're all so impatient lately - me included - I thought I'd mention it.

Along with dissolution of the gop for its collusion and cover given to DT in the killing a million + Americans, SCOTUS should also be razed to the ground and dissolved as well. We will never get back the million + American who died or erase all the pain and suffering loved ones endured (the lucky ones that is - who were able to say goodbye thru FACETIME because a caring healthcare worker held the iPad/phone) the SAME healthcare workers the pos gop and its knuckle dragging base attacked during a fucking Pandemic.
There is no forgiveness for anyone who took part in the death of so many human first, Americans second also there is nothing that cant be rebuilt. A complete wipe of the sectors the gop and its base occupy on the reality hard drive would result in nothing but benefit for the country and an argument could easily be made for the rest of the world when one simply looks at what the gop had done since just 2000.
