My husband passed away in 2017. He was involved in a class action asbestos law suit for at least 20 years before he passed. I got in touch with his lawyers and let them know he had passed away. They escalated his claims to include death. I have a lawyer who helped me with the estate, and was in touch with the asbestos lawyers. I started getting letters from CMS saying there was an overpayment and they wanted to be reimbursed. They were in touch with the asbestos lawyers and probably still are. I got a letter last year from CMS that their claim expired and a few months after that, the asbestos law firm sent me a partial settlement. I put it in a savings account and left it alone.
I just got another letter from CMS today, wanting money, again, after I thought their claim expired. Every letter I get from them says the service started January 1, 1971. He was a vigorous healthy 20 something guy in 1971 and made no claims for Medicare or Medicaid until after 2010, when he turned 65. I think I asked the asbestos attorneys about CMS when I first got CMS letters, and they said they would handle it. I looked at statute of limitations for CMS, and they are allowed to make a claim if they find out there was a settlement, and the SOL begins from that date. So is this going to go on forever and ever? I thought this was done with.
I've kept all of the paperwork from whenever the lawsuit was initiated, and all of the papers associated with my husband's illness and estate.

I think CMS is doing something wrong, and I wish the lawyers would try to get that settled. The letters mention that law firm will be notified as well, so I don't think they've been left out of the loop.
I guess someone is getting a merit badge for filing the never-ending claim. It must be easier to get blood from a turnip than a pumpkin

(4,632 posts)sheesh,,,, I think I would call my lawyer and try to get this stopped,,,, so often it isn't a person it's a computer system that is either generating the mail or putting you on a list for someone to generate that mail,,,, when does this become harassment?
