Judge Denies Injunction For Constitution Party Candidates

Pierre -- Two candidates for the Constitution Party won't be appearing on November's ballot after paperwork was filed past deadline.

On Monday, District Judge Karen Schreier denied a injunction from Libertarian Party state chair Ken Santema and Constitution Party state chair Lori Stacey. Both parties filed a suit to include Constitution Party candidates Kurt Evans and Wayne Schmidt onto the general election ballot. Evans sought to be a U.S. Senate candidate, while Schmidt filed to run in the South Dakota House.

According to state law, parties needed to file a valid candidate declaration by March 29 with Secretary of State Shantel Krebs. In court papers, the petitions for Evans and Schmidt were received on June 15.
