The anti-nepotism law (5 USC Sec. 3110) contains no such exception. On the other hand, there is an argument that family members can "work" for the executive office of the president if they don't receive a salary or other direct compensation. However, even that is questionable. For example, the anti-nepotism law obviously doesn't block the First Lady from being First Lady. Some have suggested that the First Lady isn't covered because she's not paid. But the better argument is that she isn't covered because it isn't a position to which one can be appointed or "employed." It's a title. So even if Trump's kids/in-laws took non-paying positions, there would be an argument that it violates the anti-nepotism law.

2. The law refers to an "agency".

The argument is the White House itself is not an "agency". Agencies report to the WH.
