Motion To Remove Judge Cannon From Trump-related Case FILED, But NOT In Trump's Classified Docs Case - Glenn Kirschner



Many of us have waited a very long time for Special Counsel Jack Smith to file a motion to remove Trump-appointed Judge Aileen Cannon from presiding over Trump's criminal case in Florida. Unfortunately, Judge Cannon dismissed the case before Smith ever got around to filing a recusal motion.

Then, the defendant who allegedly planned to assassinate Donald Trump - defendant Ryan Routh - was arrested and Judge Cannon was assigned to Routh's case, in which Trump is the victim.

Now, Routh's attorney has filed a motion to remove Cannon from presiding over Routh's case given Cannon's unusually close relationship to Trump.

it observes its own precedent of having removed a judge from another case based on a single motion for similar reasons. There would then be two precedents for removal based on the merits of two single filings. Given the obvious error of law that Smith's filing argued, the 11th Circuit, following a "third strike" rule for removing judges for after three overrulings, will then likely remove Cannon without Smith even having to file for her removal, anyway. He knew that, which is why he didn't add any removal motion to his latest filing for the 11th Circuit to reinstate the documents case on the docket. Law and 11th Circuit precedent are on his side, and so, knowing that the 11th won't go against its own precedents and the jurisprudence of the three 'three strike" rule, he's patient.

This new case will work in Smith's favor.
