4. So, why wasn't this caught when he applied for a Green card?

I was in the recruiting biz for over 30 years, and client companies would check any Green card holders out thoroughly. And I was never able to get any company to hire someone that didn't have a minimum of a Green card. Somebody really dropped the ball here.
